“We have heard your arguments on injunction. We don’t propose to pass any order and we will hear the matter on merits,” said the bench. A Constitution Bench led by Justice J S Khehar declined the prayer of Congress leaders that “status quo” be maintained in the crisis-hit state, so that, no new government formation is permitted till the apex court decides on the batch of petitions against various orders issued by the Arunachal Pradesh Governor, including his recommendation for the proclamation of emergency.

"We have heard your arguments on injunction. We don't propose to pass any order and we will hear the matter on merits," the bench, comprising justices Dipak Misra, M B Lokur, P C Ghose and N V Ramana, told senior counsel Kapil Sibal who appeared for Tuki.

"The decision of the constitutional authority can be annulled by the court, but this application is totally misconcieved. Either today or tomorrow, President's Rule has to be revoked and the government has to be formed," Attorney General Mukul Rohatgi said.

"Whatever is the verdict of the court, the only answer will be floor test and the ultimate answer will be the floor test. Whether 'A' becomes the Chief Minister or 'B' becomes Chief Minister, it will be decided on the floor of the House," he said.

The court order came in the course of the hearing of the petitions by the constitution bench, which had Justice Dipak Misra, Justice Madan B. Lokur, Justice Pinaki Chandra Ghosh and Justice N.V. Ramana in the bench, questioning the role of the governor in the ongoing political crisis in the border state.
